At Fossil Group, Inc., together with its subsidiaries and affiliates and owned brands, (“Fossil”, “Fossil Group”, “we”, “us” or “our”), we value your data protection rights.
This privacy policy (“Privacy Policy”) describes the processing of information provided or collected on the sites where this Policy is posted or linked (the “Website(s)”). We follow this Privacy Policy in accordance with applicable law in the places where we operate. In some cases, we may provide additional data privacy notices specific to certain products, practices, or states. Those terms are to be read in conjunction with the rest of this Privacy Policy.
Please note that this Privacy Policy does not apply to Personal Information we collect through any of our Apps or wearable technology devices. Please refer to the Privacy Policies of our App(s) for privacy information related to our wearable apps and devices.
Personal Information We Collect
“Personal Information” is information that can be used either directly or indirectly to identify you. The Personal Information we may collect about you depends on your interactions with us and our Websites. We may collect the following categories of Personal Information:
- Registration information you provide when you create an account or enter a promotion, such as your name, physical address, email address, username and password;
- Transaction information you provide when you request information, contact customer service, use our Live Customer Service Bot or purchase, return, request, or exchange a product or service from us, such as your name, postal address, telephone number and payment information;
- Commercial Information related to other aspects of our products and service, such as product reviews and sweepstakes and contest entries;
- Activity information about your use of our Websites, such as information about your browsing or search activity on our Websites, as well as your interactions with our Websites, emails or advertisements;
- Usage, viewing, technical, and device data when you visit our Websites. Every time you visit our Websites, our system stores Personal Information related to your browser, its version, the operating system of your computer, your IP address, date, length and time of your visit, the website you accessed before and the sites you visit following links on the Fossil page (For more information about our use of Cookies and similar technologies please see the “Cookies & Similar Online Tracking Technologies” section of this Policy);
- Communication data when you contact us, such as the content of emails, text messages, or other communications (only where we are the recipient of such communications); and
- Location information when you provide your zip code to locate our store(s).
How We Obtain Your Personal Information
We may obtain and combine Personal Information from different sources, collected online and offline, including information from third-party sources across different types of technology and devices. See below for details on how we may obtain your Personal Information:
- From you. We receive Personal Information from you or your actions, be it because you provided us Personal Information (i) during the account creation process, (ii) to make a purchase or customer service request and/or (iii) to participate in other capabilities, such as receiving direct marketing, leaving a review, or participating in a sweepstake;
- Through the use of certain online technologies. We collect information from our Websites through a variety of technologies, such as cookies, Flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons. - Through the use of certain in-store technologies. We may collect Personal Information from technology we use in our stores. For example, our point-of-sale terminals process your payment information when you complete your purchase, and we operate in-store cameras for security and operational purposes. These cameras may capture images of you as part of check out, to help deter theft, or improve store design to better serve our customer;
- From other Fossil Group companies. We may receive your Personal Information from other Fossil Group affiliates and/or subsidiaries, if you previously shared any Personal Information with them; and/or
- Through third-party sources. We may receive information about you from third party sources, such as publicly-available websites, service providers and partners (e.g., Facebook, Google, etc.).
How We Use Your Personal Information
In order to provide you with our services and the full range of features, we and our service providers may collect and use your Personal Information for the following purposes:
- Provide you with the products and services you request, view, engage with on our Websites;
- Fulfill your transactions on our Websites, including billing information, receipt information, shipping information and in-store pick up information (where available);
- Fulfill customer service-related requests, including returns, exchanges, service repairs and warranty claims;
- Facilitate Virtual Shopping appointments to offer you a remote shopping experience;
- Communicate with you about your customer account and your transactions with us, as well as send you information about features on our sites or changes to our policies, through methods like our Live Chat functionality;
- Email you personalized reminders, offers and promotions for our products and services, including emails about cart abandonment;
- Text message you (i) automated, pre-programmed messages about our Website, our products and our services, (ii) automated messages that are based on your interaction with our Website, like cart abandonment reminders (only when you opt-in to receive any such text messages);
- Text message you non-automated, personalized messages from your preferred Fossil store (only when you opt-in to receive any such text messages);
- Support a customer loyalty program, as well as gift cards, referrals and discounts;
- Personalize Website content, including product recommendations;
- Operate, understand, optimize, develop, or improve our Websites, products, services and operations, including by using guest survey research and analytics tools;
- Detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal;
- Comply with our legal or regulatory obligations, establish or exercise our rights, and defend against a legal claim;
- Evaluate your eligibility for employment at Fossil Group (only where you submit an employment application or similar request to us);
- Notify you of product recalls or safety issues;
- Share, publish and/or repost pictures and other materials you share with us via social media;
- Administer contests, sweepstakes and other promotions sponsored by us; and
- Link the different devices you are using to save your preferences, analyze your usage of our Websites, provide interest-based advertising to you and deliver tailored ads across multiple devices.
How We May Disclose Your Personal Information
We may share your Personal Information in the following cases:
- Legal obligation and internal purposes. We disclose your Personal Information:
- in order to comply with relevant laws, regulatory requirements and to respond to lawful requests, court orders, and legal processes, including requests to meet national security or law enforcement requirements;
- in order to protect and defend the rights or property of us or third parties; and/or
- in an emergency, in order to protect the safety of our employees or any person.
- Joint processing within Fossil Group. Your information will be combined with other Personal Information that Fossil Group companies have obtained about you (e.g., goods you have purchased on a company website or from a store, repair transactions). We will also make your data available to Fossil Group companies if you apply for a job with us. We base this joint processing on an intra group agreement, allocating the responsibilities of the respective group entities. According to this agreement, each Fossil Group company will be responsible for the data processing related to its own business operations and will remain responsible for the Personal Information jointly processed with others. For you, as our customer, this means that the Fossil entity you are in touch with is responsible for processing your data and answering your requests. If you are not sure about the entity responsible in your case, please contact privacy.
- Links to Third-Party Websites and Services. On some Websites we allow you to share Personal Information with third parties, such as social networks, like Meta. In these instances you are agreeing to the data being shared and the shared data being subject to the privacy policies of the third party. We do not control and do not assume any responsibility for the use of Personal Information by such third parties. For more information about the third party’s purpose and scope of their use of Personal Information in connection with sharing features, please visit the privacy policies of such third parties.
- Third-Party Advertising. We use third-party service providers to display advertisements across the internet. These advertising service providers may collect information about your visits to our Websites and your interaction with our products and services, as well as your visits to other websites. Such information does not include your name or address, but may contain browser-related information.
- Public Disclosure. When you post a product review or upload an image or other material to our Website, or when you share content with us on third-party websites, such as social media networks, we may publish and use this information on our Website and third-party websites.
- Please note: Information shared with third-party websites is not under our control. We are not responsible for the use of that information by such third party websites. Please refer to the applicable third parties privacy policies for more information about how your Personal Information is handled by them.
- Sharing with third parties. We engage third-party service providers who are allowed to use Personal Information only on our behalf and must not use it for their own purposes, unless permitted by law. The following is a list of categories of services and functions along with example recipients:
- to enable the functionality of our online application portals (e.g. IBM);
- to provide customer care services (e.g. Salesforce, 8×8, Transcosmos);
- providing hosting and general IT services (e.g. Amazon Web Services and Google);
- using data cleansing techniques in order to ensure your data, such as your address, is correct (e.g. Acxiom Corporation);
- for functional, social, analytical technologies and technologies enabling behavioral marketing (for more details, please refer to the “Cookies & Similar Online Tracking Technologies” section of this Policy);
- for social media services (e.g. Meta or Google);
- providing payment services (e.g. PayPal, Klarna, iDEAL, Bancontact);
- for transport and logistics services (e.g. DHL, DPD, Post AT, La Poste, UPS);
- for direct marketing campaigns (e.g. Google, Facebook); and/or
- to administer sweepstakes, contests and competitions (e.g., Salesforce).
- Transfer of Assets. We may transfer your Personal Information to a third party in the event of a transfer of all or some of our assets to a third party, such as a merger, acquisition or novation.
How Long We Maintain Your Personal Information
We will retain your Personal Information (a) as long as necessary to provide you with functionality and services as described in this Privacy Policy, (b) as long as reasonably necessary to further our legitimate interests or (c) as long as we are required by law. Examples include the defense against, or the establishment of legal claims and legal obligations (e.g. tax law, or the principle of accountability, which requires us to demonstrate that our processing complies with applicable data protection laws). As an example, in order to verify whether you opted out or in for marketing activities, we store your respective choice (e.g., via a cookie or a declaration).
How We Keep Your Personal Information Safe
We have implemented commercially reasonable physical, organizational, contractual and technological security measures with a view to protecting your Personal Information and other information from loss or theft, unauthorized collection, use and disclosure. Despite the measures outlined above, no method of information transmission or information storage is 100% secure or error-free, so we, unfortunately, cannot guarantee absolute security. Cookies & Similar Online Tracking Technologies
As mentioned in the “How We Obtain Your Personal Information” section of this Privacy Policy, we and our third–party partners and service providers use pixels, web beacons, software developer kits, cookies, and other similar online tracking technologies (collectively, “Online Tracking Technologies”) to gather information about how you use our Websites. See below for more information on how we collect and use Personal Information obtained via Online Tracking Technologies, as well as how to disable or opt-out of certain Online Tracking Technologies:
I. How We Collect Information via Online Tracking Technologies
Our Websites use Online Tracking Technologies to collect and store information about your interaction with the Websites, including your cart activity, your location, device type and identifier, operating system and browser type or similar information, as well as your online activities over time and across different websites.
A cookie is a small file consisting of letters and numbers. This file uniquely identifies and recognizes your browser or device and transmits information to the server. They may collect information including clicks, cursor movements, and other interactions with pages on our site. They help us to know which pages, emails, and online content are the most and least popular and see how visitors move around and interact with our site. For example, they allow us to measure how effective our ads are in bringing visitors to our site.
In addition to cookies, our Websites and/or emails may use:
- Web Beacons and pixels. Our Websites may contain small pieces of code called web beacons (also known as clear gifs, pixel tags, and single-pixel gifs) that collect information on user behavior such as interactions with the Website, pages viewed, purchases, conversions, or ad performance. They may also track a user’s interactions across websites and ads.
II. How We Use Information Collected via Online Tracking Technologies
- Aggregate Analysis. We engage a third-party service provider, Content Square, Inc. (“ContentSquare”), to track mouse movements, clicks and mobile interactions on our Websites. This tracking data is securely sent to ContentSquare servers, where it is aggregated and prepared for analysis. ContentSquare then provides us with actionable insights and recommendations, which help us to improve our Websites experiences and better market our products.
- Email Tracking. If you receive email from us, we use certain Online Tracking Technologies to capture data related to when you open our email, click on any links or banners it contains, or make purchases. We use this information for marketing purposes and to learn more about our audience at the aggregate level.
- Cross-Device Identification. In order to save your preferences, analyze your usage of our Websites, provide interest-based advertising to you and deliver tailored ads across multiple devices, we try to link the different devices you are using to you. For example, we try to understand when you visit our Website from our phone and when you visit on your computer. To do so, we store cookies on the devices that you use to visit our Websites and link those cookies within our internal database.
- Advertising & Personalization. We and our authorized third parties and service providers use Online Tracking Technologies on our Websites for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests or to send abandoned shopping cart reminders (depending on your communication preferences). We and these third parties and service providers use technology to provide advertising about products and services tailored to your interests which may appear either on our Websites or on other websites.
III. How to Set Your Preferences for Online Tracking Technologies

We may leverage artificial intelligence technology (“AI”) to help increase our efficiency. For example, we may use AI to assist with Customer Care requests that we receive, like helping us find the right answer to your question faster or creating a summary after the fact.

Fossil Mobile Program
If you would like to receive automated text messages from Fossil, you can join the Fossil Mobile Program. See below for a quick guide to Fossil’s Mobile Program. For more information, see the Fossil Mobile Program Terms of Use.
- How to Opt-In: If you would like to receive automated text messages from Fossil, you must opt-in by (1) visiting the Fossil Website on your mobile phone or desktop, (2) providing your mobile phone number and (3) consenting to Fossil’s Mobile Program Terms of Use and Fossil’s Privacy Policy. By opting in, you agree to receive text messages from Fossil.
- Program Description: Fossil will text you about things like Website promotions, birthday messages, new and existing Fossil products and reminders about products sitting in your online shopping cart.
- How to Opt-Out: If you would like to be removed from the mobile program, text “STOP.” One additional text message will be sent as confirmation of the opt-out. No additional text messages will be sent after the confirmation of opt-out. You can opt back in at any time by following the steps above.
- Supported Carriers: AT&T, Sprint, T-Mobile®, Verizon Wireless, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, among others. Message and data rates may apply.
- Third-Party Sharing: Fossil does not share (i) that fact that you’ve opted-in-to the Fossil Mobile Program or (ii) the mobile phone number you provide at sign-up with third parties for additional marketing or advertising purposes.

- Program Description: Your Fossil store will text you about things like personalized product recommendations, updates inventory and other store-specific information.
- How to Opt-Out: If you would like to be removed from the Fossil Store Chat Program, text “STOP,” “STOP ALL,” “Unsubscribe,” “Cancel,” “Quit” or “End” within the existing text message thread.
Please note that the Fossil Mobile Program and the Fossil Store Chat Program are completely unrelated to one another because each program requires separate and distinct consent. For greater clarity:
- The Fossil Mobile Program utilizes automation to send marketing text messages whereas the Store Chat Program does not;
- Your consent to join the Fossil Store Chat Program is not consent to join the Fossil Mobile Program and vice versa; and

Children’s Privacy
We do not knowingly collect, maintain or use Personal Information about children under the age of 16 years’ old. Videos on Our Website
Our Websites may display brief videos featuring our products. Please note that these videos are incidental to our business purpose. They are used for adding to the design of the Website and only act as a type of silent digital billboard vs a typical media function, such as entertainment.

State Privacy Rights
Many US states have enacted comprehensive data privacy legislation. Depending on where you live, you may be entitled to additional rights with respect to the Personal Information we have about you. Once we receive your request, we may attempt to verify your identity by sending you an email with a link to verify your email address. Following this, we may ask you one further verification question. Once the verification process is complete, we will send you emails with login credentials to our secure privacy portal for you to access, download or instruct us to delete your Personal Information.
Once we verify your request, if applicable, we will fulfill (or deny, where permissible and necessary) within 45 days of receipt. If we deny your request, or require more time, we will provide you with notice and explanation of the reason.

- Appealing a Decision about your Privacy Rights
In cases where you submit a request to exercise one or more of your privacy rights and that request is denied by us, we will inform you about our justification for such denial within 45 days of receipt of your request. You may object to our decision by emailing us at privacy within a reasonable period of time after receiving that decision from us. In that email, please explain why you may disagree with our decision. Within 45 days of receipt of your objection, we will inform you in writing of any action taken or not taken, accompanied by our justification.

California
This section applies to California residents, as required by the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020).
Categories of Personal Information Collected
In the preceding 12 months, we have collected the following categories of Personal Information about California residents:
- identifiers such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, and/or other similar identifiers;
- personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) such as signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information;
- protected classification characteristics under California or federal law, such as age (40 years or older) and/or sex (gender);
- commercial information such as products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;
- internet or other similar network activity such as browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement;
- audio / visual data such as audio, electronic, visual, thermal, olfactory, or similar information (e.g., recordings of calls with customer care); and
- inferences drawn from other personal information such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
We do not knowingly collect personal information from California residents between the ages of 13 and 16. Likewise, we do not collect or process Sensitive Personal Information to infer characteristics about you. We only collect and process Sensitive Personal Information in accordance with the permissible purposes stated under Section 7027(m) of CPRA. Given this, we do not provide a “Notice to Limit” link on our website.

We may obtain and combine Personal Information from different sources, as described in the “How We Obtain Your Personal Information” section of the Privacy Policy and re-provided below:

How We Use Your Personal Information
We may use your Personal Information for the purposes described in the “How We Use Your Personal Information” section of the Privacy Policy and re-provided below:

- Fulfill your transactions on our Websites, including billing information, receipt information, shipping information and in-store pick up information (where available);
- Fulfill customer service-related requests, including returns, exchanges, service repairs and warranty claims;
- Facilitate Virtual Shopping appointments to offer you a remote shopping experience;

Disclosing Personal Information for Business Purposes
We may use or disclose the Personal Information we collect for “business purposes” or “commercial purposes” such as security, debugging/repair, performing services on behalf of the business or service provider, advance a person’s commercial or economic interests, quality, safety maintenance and verification of a service or device, enabling or effecting a commercial transaction, etc.

Your California Privacy Rights
If you are a California resident, you have the following rights:
- Right to Access: You have the right to know and see what personal data we have collected about you in a usable format. Specifically, you can request the following information:
- the categories of Personal Information we collected about you;
- the categories of sources from which the Personal Information is collected;
- the business or commercial purpose for collecting or selling Personal Information;
- the categories of third parties with/to whom we share/sell Personal Information; and
- the specific pieces of Personal Information we have collected about you.
- Right to Delete: You have the right to request that we delete the personal data we have collected about you, subject to applicable legal exceptions.
- Please note that choosing to delete your Personal Information may impact your ability to use certain aspects of our Websites and online features, such as your Customer Account on our Websites.
- Right to Correct: You have the right to request that we correct inaccurate personal data.
- Right to Opt Out of the Sale of Personal Data: You have the right to opt out of the Sale of your Personal Information for cross-context behavioral advertising.
- Please note that opting out of the sale or share of your Personal Information will stop the sale or sharing of your Personal Information that is connected to the email address submitted with the request. However, some interactions you have with us are not connected to your email address. For instance, we sell or share certain Personal Information through the use of cookies, tags and/or pixels provided by third parties, which are not connected to your email address. If you wish to customize your cookie preferences, you can do so within the Privacy Preferences Center.
- Right to Limit the Use and Disclosure of Sensitive Personal Information: Although California law permits you the right to limit the use and disclosure of Sensitive Personal Data, we do not collect or process Sensitive Personal Information for the purpose of inferring characteristics about you and/or for the purposes stated under section 7027, subsection (m) of CPRA. Thus, we do not provide a Notice of Right to Limit link on our Websites.
- Right to Opt Out of Automated Decision Making: Although California law permits you the right to opt out of automated decision making, including profiling, we do not process your Personal Information for that purpose. Thus, we do not need to offer you this right.
- Right to No Retaliation / Discrimination: We will never retaliate nor discriminate against you if you choose to exercise any of your privacy rights.
- Please note that we may charge you a different price or rate, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to you by your Personal Information (e.g., your identifiers).
Exercising Your California Privacy Rights
To exercise your access, correction and deletion rights described above, you can submit a request via the following methods:

- To opt out of the sale or share of your offline data associated with your email address: visit the Privacy Preferences Center, provide your email and then click “Submit”;
- To opt-out of cookie-based sales/shares/targeted advertising: visit the Privacy Preferences Center, unselect (a) Performance and Functionality and (b) Advertising and then click “Save”;
- Complete this Customer Support webform.
- Note: Submitting this form only opts you out of the sale/share of your offline data associated with your email address. You will still need to opt out of cookie-based sales/shares, if you so choose, as described above.
- Email us at privacy; or
Once we receive your request, we will attempt to verify your identity by sending you an email with a link to verify your email address. Following this, we will ask you one further verification question. Once the verification process is complete, we will send you emails with login credentials to our secure privacy portal for you to access, download or instruct us to delete your Personal Information.
Once we verify your request, we will fulfill (or deny, where permissible and necessary) within 45 days of receipt. If we deny your request, or require more time, we will provide you with notice and explanation of the reason.
Use of Authorized Agent
You may use an authorized agent to submit a request to access, delete and to opt-out on your behalf if you provide the authorized agent written permission to do so and verify your own identity directly with us. “Authorized agent” means a natural person or a business entity that a consumer has authorized to act on their behalf. We may deny a request from an authorized agent who does not submit proof that they have been authorized by you to act on your behalf, unless you have provided the authorized agent with power of attorney, pursuant to Probate Code sections 4000 to 4465.
Notice of Financial Incentive
In addition, we may offer financial incentives, including payments to you as compensation, for the collection of Personal Information, the sale of Personal Information, or the deletion of Personal Information. We may also offer a different price, rate, level, or quality of goods or services to you if that price or difference is directly related to the value provided to you by your Personal Information. We may enter you into a financial incentive program only if you give us prior consent which clearly describes the material terms of the financial incentive program, and which may be revoked at any time. We shall not use financial incentive practices that are unjust, unreasonable, coercive, and/or usurious in nature.
